Required In-Person Inspection following DHS Remote Inspection
I-9 Process Guidance, article published 08/30/2021
The DHS guidance for remote I-9 inspection is set to expire 8/31/2021. While in certain scenarios we still may experience challenges in having to physically inspect documents no later than three business days after the DHS remote inspection policy ends, as a reminder, the original guidance provided by ICE states:
Please note that ICE and USCIS have not provided clear guidance on when the three business days start for in-person verification and document inspection. ICE stated "once normal operation resumes" which can vary by VC Area and even department. We will continue to follow county guidance and requirements, and currently, there isn't a specific date on when normal operations will resume for UC San Diego.
For departments that have employees/new hires come in person, follow county's health expectations on in-person interactions, and if those indicate it is risky to have contact, note the reason in the audit notes for these employees and wait until in-person interaction is appropriate. If you are unable to conduct in-person verification and document inspection within the 3 day period, please provide detailed reason in Tracker's audit note section with Batch Name 'COVID-19'.
We don’t need to wait until normal operations resume to begin in-person verification of documents. This can be conducted earlier to minimize potential bottle neck of having to complete the inspection within 3 days. The verification can be done in person or through the Remote Section 2 Amendment via an authorized representative. This job aid provides step by step instructions on how to complete the Remote Section 2 Amendment for in-person verification through an authorized representative.
For upcoming hires, if an in-person verification is not feasible, the recommended best alternative is to complete the I-9 via an authorized representative.
